This Privacy Policy applies to all of the products and services (the “Services”) offered
by Armstrong Software, LLC (doing business as “App My Community,” and referred to
herein as “AMC”, the “Company,” “we,” “us,” and “our,” which terms shall include
affiliates of Armstrong Software, LLC), and describes how the Company collects, uses,
discloses, and protects information in connection with the Services, our websites
located at https://www.appmycommunity.com, https://www.resortnavigator.net (including
customer specific subdomains hosted through resortnavigator.net),
https://www.armstrongsoft.com (which may redirect to
https://www.appmycommunity.com), and any other websites we operate that link to this
Privacy Policy (collectively, the “Websites”) and our white labeled mobile applications
using the App My Community framework (the “App My Community Apps” or the
“Apps”, and collectively, the Services, the Websites and the Apps, or any applicable
component(s) of any of the foregoing, the “AMC Platform”).
We provide this Privacy Policy to let you know what information we collect, how we use
it, how we share it, and how we protect it. Please read this Privacy Policy carefully. BY
USING THE AMC PLATFORM, YOU AGREE TO THIS PRIVACY POLICY. IF YOU DO
NOT AGREE, DO NOT VISIT THESE WEBSITES, SET UP AN ACCOUNT OR USE
THE APP MY COMMUNITY APPS OR THE SERVICES.
The AMC Platform is offered in the United States and may also be offered in other
countries where the Company or its Customers operate (including, without limitation,
Canada, Australia, New Zealand, and Mexico).
Additional Context Regarding White-Labeled Apps and Locations:
The Company provides the AMC Platform to allow campgrounds, RV resorts,
communities, municipalities, and other organizations (each, a “Customer”) to offer
customized, branded mobile applications for one or more of their locations (each, an
“App My Community Location” or “Location”) to their guests, visitors, residents,
members, or staff (“End Users”). Depending on how a Customer configures its App and
features, certain information you submit through a Customer’s App may be shared with
that Customer so it can provide services to you (for example, responding to requests,
managing reservations or purchases, or sending communications). Customers also may
have their own privacy practices and policies. If you have questions about a Customer’s
use of information, you may need to contact that Customer directly.
Information Gathering and Usage:
When you register with the Company, we may ask for information such as your name,
location, and email address. You may also choose to submit information requests or
other information to a specific Customer or Location through the AMC Platform. We may
also ask you to create a username and a password.
All personal information provided to the Company is hereinafter referred to as
“Personal Data”. We store this information and use collected information for the
following general purposes: providing and improving the AMC Platform, identification
and authentication, contacting Customers and End Users, and research.
We do not share your Personal Data with unrelated third parties except as described in
this Privacy Policy (for example, with service providers who help us to operate the AMC
Platform, with Customers or End Users as part of providing the AMC Platform, or where
required by law).
By voluntarily providing us with Personal Data, you consent to our use of it in
accordance with this Privacy Policy. If you provide Personal Data to us, you
acknowledge and agree that such Personal Data may be transferred and stored from
your current location to the offices and servers of the Company and the authorized third
parties referenced in this Privacy Policy.
Aggregated Personal Data:
In an ongoing effort to better understand and serve the users of the AMC Platform, the
Company may conduct research on customer demographics, interests and behavior
based on Personal Data and other information provided to us. This research may be
compiled and analyzed on an aggregate or de-identified basis, and the Company may
share this aggregate or de-identified data (“Aggregate Information”) with its affiliates,
agents and business partners. Aggregate Information does not identify you personally.
The Company may also disclose aggregated user statistics to describe the AMC
Platform to current and prospective business partners, and to other third parties for
other lawful purposes.
Location Data:
The AMC Platform may collect and use precise location data from your device(s) if you
choose to enable location services (for example, by permitting access to GPS or other
location features on your mobile device) to provide certain functionality of the AMC
Platform. You can control location permissions through your device settings. If enabled
for a particular App or Location(s), location information may be used to support features
such as maps, on-property content, geofencing functionality to determine whether you
are on or off a property, and/or help deliver notifications to you when you are using the
applicable App or you are on or near the applicable Location(s). In some cases,
geofencing functionality may operate while the App is running in the background in
order to determine on-property or off-property status.
The AMC Platform does not store or retain historical location data. Instead, the system
may retain only a current status indicator (such as an “on-property” or “off-property” flag)
necessary to enable certain App features.
This location data is used to provide you a better user experience and is not intended to
be publicly displayed or shared with other Customers or End Users. We may also use
location information in an aggregated or de-identified manner, as described above in the
“Aggregated Personal Data” section.
Images and Photos:
App My Community Apps may ask for and collect images and photos (for example,
costume contest judging or photos of golf carts, sites, or holiday decorations). If you
choose to upload any photos to an App My Community App, the applicable Customer
and/or App My Community Location will have access to those photos, and you grant the
applicable Customer and App My Community a non-exclusive, royalty-free license to
use, display, reproduce, and distribute such images in connection with the operation of
the applicable App and the Customer’s related activities, including for operational, social
media or marketing purposes, subject to the Customer’s or Location’s own policies and
applicable law. Each Customer or Location is responsible for its own use of submitted
images and for providing any additional notices or obtaining any additional consents it
determines are necessary under applicable law. App My Community will not use such
images for its own social media or marketing purposes without your consent.
Advertising Partners:
The Company may, where applicable, use third-party advertising partners in connection
with the Websites to deliver content or advertisements, which may use cookies, web
beacons or pixel tags. For clarity, the Company currently only uses such advertising and
marketing technologies in connection with the Websites, and not for delivering targeted
advertising within the Apps. If the Company engages in additional advertising practices
in the future, this Privacy Policy will be updated accordingly. No directly identifiable
Personal Data is shared with advertising providers. These advertising service providers
may collect non-identifiable information about your use of and interactions with the AMC
Platform. Such non-identifiable information does not include your name, address, email
address or other Personal Data.
In addition to the information about your use of and interactions with the AMC Platform,
our service providers may also use information about your visits to other websites to
help target advertisements for services available from the Company on the Websites.
Customers may choose to display advertisements within their own Apps, and such
advertisements are controlled by the applicable Customer. App My Community does not
currently use third-party advertising networks to deliver targeted advertising to End
Users within the Apps. The Apps may use device identifiers or similar technologies for
analytics, performance monitoring, or other operational purposes, but not for targeted
advertising by the Company.
Google Analytics:
The AMC Platform (including the Websites and the Apps) uses Google Analytics to
track statistics regarding our audience, App usage, and Website traffic. No personally
identifiable information is transferred from any of the AMC Platform components to
Google Analytics. For more information on Google’s Analytics privacy policies and
practices, please refer to Google’s privacy policy.
From time to time, the Websites may engage in remarketing efforts with third-party
companies, such as Google, Facebook, or Instagram, in order to market the Websites.
These companies use cookies or similar technologies to serve ads based on prior visits
to the Websites. Google Analytics is used by the Company within the Apps for reporting
and analytics purposes only and not for delivering targeted advertising within the Apps.
At any time, you may opt out of Google Ads by modifying your Google Ads settings.
Our Disclosure of Your Personal Data and Other Information:
We may use your email address to send you information about the AMC Platform or to
market to you. You may unsubscribe from these messages by following the instructions
contained within the messages. In addition, if at any time you no longer wish to receive
any future marketing communications or you wish to have your name and mailing
information deleted from our mailing lists, please contact us as
at [email protected] If you contact us, we may retain your message and
contact information to respond to or otherwise follow up with you.
Except as otherwise provided in this Privacy Policy, the Company will not sell your email
address(es) or other Personal Data, or disclose such information to third parties, without
your consent, except where required by law. In certain circumstances, however, we may
share Personal Data with certain third parties without further notice to you, as set forth
below:
Business Transfers:
As we develop our business, we might sell or buy businesses or assets. In the event of
a corporate sale, merger, reorganization, dissolution or similar event, Personal Data
may be part of the transferred assets.
Related Companies: We may share your Personal Data with our affiliated or related
companies for purposes consistent with this Privacy Policy.
Agents, Consultants and Service Providers: We may share Personal Data with
vendors and service providers who perform services on our behalf, such as hosting,
database management, analytics, crash reporting, communications (mail, email and
push notification delivery), customer support tools, and payment processing. These
providers are authorized to use Personal Data only as necessary to provide services to
us.
Legal Requirements: The Company may disclose your Personal Data if required to do
so by law or if we believe in good faith that such action is necessary to (i) comply with
legal obligations, (ii) protect and defend the rights or property of the Company,
(iii) protect the safety of users of the AMC Platform or the public, or (iv) protect against
legal liability.
Third-Party Use of Personal Information:
The Company may provide Personal Data to third-party service providers to help
operate and improve the AMC Platform, and we limit such service provider’s use of
such Personal Data to providing services to us. The App My Community Apps use
Firebase for certain database services, and Firebase’s use of your personal information
is subject to Firebase’s privacy policy.
Other than as described in this Privacy Policy, we do not disclose Personal Data to
third-party applications.
Your Choices:
You can visit the Websites without providing any Personal Data. If you choose not to
provide any Personal Data, you may not be able to use certain Services or Apps. You
may request deletion of your Personal Data by sending an email
to [email protected]; however, in some cases we may be required by law to
retain certain information. In such a cases, and to the extent permitted by applicable
law, such retained information would no longer be active on the AMC Platform and
would be maintained separately by the Company in an archive.
U.S. State and International Privacy Rights:
Depending on where you reside, you may have certain rights with respect to your
Personal Data under applicable U.S. state privacy laws (such as the California
Consumer Privacy Act, the California Privacy Rights Act, and similar laws in other
states) and/or applicable international privacy laws. These rights may include the right
to request access to, correction of, or deletion of your Personal Data, and the right to
opt out of certain processing activities.
To exercise applicable privacy rights, you may contact us using the information provided
in the “Questions” section below. We may need to verify your identity and your
relationship to a Customer or Location before processing your request. In some cases,
and depending on the nature of the request, we may direct you to submit your request
to the applicable Customer or Location if that Customer or Location controls the relevant
Personal Data.
If you are located outside the United States, including in the European Economic Area
(“EEA”), the United Kingdom, or Switzerland, please note that the Services are
operated from the United States and your Personal Data may be transferred to, stored
in, and processed in the United States or other countries where we or our third-party
service providers operate (including jurisdictions where the Company or its Customers
operate).
For purposes of the General Data Protection Regulation (“GDPR”) and similar data
protection laws, the Company may act as a data processor or service provider when
processing Personal Data on behalf of a Customer, Location or End User, and as a data
controller with respect to certain information collected through the AMC Platform or for
its own business purposes. If you have questions about the lawful basis for processing
or wish to exercise applicable GDPR rights, you may contact us using the information
provided in the “Questions” section below. In some cases, we may direct you to the
applicable Customer or Location as the data controller responsible for responding to
your request.
Exclusions:
This Privacy Policy applies only to Personal Data collected through the AMC Platform,
and does not apply to Personal Data collected by the Company via other means. This
Privacy Policy does not apply to unsolicited information you provide to The Company,
including, without limitation, information posted to any public areas of the AMC Platform,
such as forums, ideas, suggestions, or submissions for new products or modifications to
existing products (collectively, “Unsolicited Information”). All Unsolicited Information
shall be deemed to be non-confidential and the Company shall be free to reproduce,
use, disclose, and distribute such Unsolicited Information to others without restriction,
limitation or attribution.
App My Community Customers and Locations:
When accessing an App My Community App, you may be presented with a list of
Customers and App My Community Locations. Upon selection of a Customer or an App
My Community Location, you may receive information related to, and may be able to
access messages posted by, that particular Customer or App My Community Location.
In addition, the applicable Customer(s) and App My Community Location(s) may be
able to view and use certain information you submit through the App (such as requests,
bookings, purchases, messages, or photo submissions) as needed to provide services
to you.
Customers and App My Community Locations generally do not receive access to your
Personal Data unless (i) you provide it through the App directly to the Customer or App
My Community Location, or (ii) the Customer or App My Community Location enables
features that require sharing information in order to provide services to you. In the event
that you provide personal information to a Customer or an App My Community Location
and such information is wrongly disclosed, we are not liable for, and shall not be
required to indemnify you or otherwise pursue any wrongful disclosure claim on your
behalf regarding the wrongful use of your data and information.
Data Storage:
We use third-party vendors and hosting partners to provide the necessary hardware,
software, networking, storage, and related technology required to run the AMC Platform.
We do not transfer ownership of any code, databases, Website rights or data to any
third-party vendors or hosting partners.
Device Information:
We may collect information about the device you are using when accessing the AMC
Platform, including device type, operating system, device identifiers, settings and crash
data. Collection of such information depends on your device type and settings. To learn
more about what information your device makes available to us, please review your
device manufacturer’s and/or your software provider’s policies.
Cookies
Cookies are small data files, which often include an anonymous unique identifier, that
are sent to your browser from a web site’s computers and are stored on your device.
Cookies are required in order for you to use certain features of the AMC Platform. We
use cookies to record session information and to improve the Services, but we do not
require permanent cookies.
Third-Party Services
We may use a variety of services offered by third parties to help develop, maintain,
provide and improve the AMC Platform, and to help us understand the use of the AMC
Platform. If and to the extent that any third parties obtain access to your Personal Data
information as a result of the provision of services to us, their use of such Personal Data
is limited to providing such services to us.
Links to Other Websites
This Privacy Policy applies only to the AMC Platform. The Websites and App My
Community Apps may contain links to other websites not operated or controlled by the
Company (the “Third-Party Sites”). The policies and procedures described in this
Privacy Policy do not apply to the Third-Party Sites. The links from the Services do not
imply that the Company endorses or has reviewed the Third-Party Sites. We encourage
you to review the privacy policies of the Third-Party Sites.
Policy Towards Children
The AMC Platform is not directed to children under the age of 13. We do not knowingly
collect Personal Data from children under the age of 13. If you become aware that a
child has provided Personal Data, please contact us at [email protected].
Information Security, Retention, and Data Integrity:
We take reasonable security measures to protect Personal Data against unauthorized
access, alteration, disclosure or destruction. Access to Personal Data is limited to our
employees, contractors and agents who need to know that information to operate,
develop or improve the AMC Platform. These individuals are bound by confidentiality
obligations and may be subject to discipline, including termination, if they fail to meet
these obligations. However, we are unable to guarantee that the security measures we
take will not be penetrated or compromised or that your information will remain secure
under all circumstances.
Access:
You retain the right to access, amend, update, correct or delete your Personal Data by
contacting [email protected]. While we would be sorry to see you go, you
can delete your account at any time. Keep in mind, however, that even if you delete
your account, we may retain certain Personal Data as required by law or for legitimate
business purposes, including compliance, fraud prevention, dispute resolution,
troubleshooting, enforcement of the terms of this Privacy Policy (and the other terms
and conditions applicable to the AMC Platform), and to take other actions otherwise
permitted by law. There may be residual personal information that remains within our
databases, access logs, and other records. In addition, we are not responsible for
updating or removing Personal Data that has been disclosed to third parties acting
independently of the Company, including Customers or App My Community Locations,
where such disclosures are permitted by this Privacy Policy.
Email Communications:
If you send us an email with questions or comments, we may use your Personal Data to
respond and we may retain such communications for future reference. For security
reasons, we do not recommend that you send non-public personal information, such as
passwords, social security numbers, or bank account information, to us by email. You
may “opt out” of receiving future marketing emails from us by using the “unsubscribe”
link included in our messages, though we reserve the right to send you transactional or
service-related communications.
General Terms:
We reserve the right to update this Privacy Policy from time to time. Any change, update
or modification will be effective upon posting the revised Privacy Policy on the Websites.
While we have no obligation to provide notice to you of any such changes, updates or
modifications, we may provide additional notice for material changes. It is your
responsibility to review this Privacy Policy from time to time to ensure that you continue
to agree with all of its terms. Your continued use of the AMC Platform after changes are
posted to this Privacy Policy constitutes your acceptance of the revised Privacy Policy.
This Privacy Policy is governed by and construed in accordance with the laws of the
State of Missouri, without regard to its conflict of laws principles. We and you each
agree to submit to the personal jurisdiction of the state courts located in Lincoln County,
Missouri and the federal courts located in the Eastern District of Missouri.
Our failure to exercise or enforce any right or provision of this Privacy Policy shall not
constitute a waiver of such right or provision. This Privacy Policy is hereby incorporated
by reference into, and forms a part of, the terms and conditions governing use of the
AMC Platform, including any applicable master services agreement, website terms of
use, end user license agreement, or similar agreement. You may not assign this Privacy
Policy to any party. If any provision of this Privacy Policy is deemed invalid, then that
provision will be limited or eliminated to the minimum extent necessary, and the
remaining provisions of this Privacy Policy will remain in full force and effect.
